1. INTRODUCTION

These terms and conditions (Terms) govern your use of Chotcut on the Webpage and Mobile Application to sign up as a Store and shall govern your use of Chotcut services. These terms and conditions govern the agreement between you and Chotcut. You are required to read, understand and agree to these terms. By using Chotcut, you agree to be bound by these terms and agree with the collection, use and disclosure of your Store information in accordance with Chotcut privacy policy. The information which may include but not limited to your store address, products and pricing.

2. CONDITION OF USE

When signing as a store owner on any Chotcut Platform, your information will be used to create an account. You may not sign up more than once with respect to the same store. You will take all reasonable steps to protect your log in details and keep them secret, including any access codes you may be sent to access your account. You are responsible for all activities performed using the Chotcut whether the access is authorised by you or not.

3. PROPRIETARY RIGHTS

All trademarks, copyright, database rights, patent, and other intellectual property rights of any nature in which are properties of Chotcut together with the underlying software code, its affiliated content (which may be accessed outside of the website or App on Chotcut’s-controlled webpages), and any and all rights in, or derived from Chotcut are all owned by Chotcut either directly or by licensed and it’s protected by applicable laws. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of Chotcut in compliance with these Terms and the Agreement. Chotcut hereby grants you a non-exclusive, non-transferable, non-sublicensable, and perpetual revocable license to use the website for your lawful use in accordance with these Terms and the Agreement on your Device. Chotcut retains all rights, title, and interest in and to the website, and its other intellectual property. This license starts on the date that you accept these Terms on the website. The license ends on termination of the license in accordance with these Terms or the Agreement.

4. TERMS AND CONDITIONS OF SALE

I. You acknowledge and agree to:

• provide an online location for buyers to purchase products;
• contract for the sale of a product or products with the buyer, and accordingly you commit to selling the relevant product or products, upon the buyer’s confirmation of purchase via the website

II. Subject to these general terms and conditions, the Chotcut’s terms of business shall govern the contract for sale and purchase between the buyer and the store owner. Notwithstanding this, the following provisions will be incorporated into the contract of sale and purchase between the store owner and Chotcut:

• Products to be supplied must be in good form and condition before it is handed over to the pilots.
• Products or goods to be supplied must be the same as described on Chotcut website. No modification shall be made regarding the size and brand.
• The pricing of the product(s) must be same as it appears on the relevant product listing. Where there is a change in prices of products, the store owner is expected to update the necessary details or contact Chotcut with the updated prices. Nothing in this section excludes a store owner from fixing the prices on their products.
• Where an item(s) is sold out or out of market, the store owner is expected to update it on the relevant products listing from time to time.
• You may not use or promote the use of any form of modifications, exploits, or other unauthorised means to interfere with, or gain undue advantage in your use of the Chotcut Platform.
• Chotcut failure to monitor or enforce a provision of these Terms does not constitute a waiver of its right to do so in the future with respect to that provision, any other provision, or these Terms as a whole.

5. DISCLAIMER AND LIMITATION OF LIABILITY

Chotcut website IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHOTCUT DISCLAIMS ALL REPRESENTATIONS, CONDITIONS, AND WARRANTIES, EXPRESS, LEGAL, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

6. RULES ABOUT YOUR CONTENT

• Your content in this context means all works and materials including but not limited to text, graphics, images, that you submit to us or our website for storage or publication, or transmission.
• Your content, and the use of your content by us in accordance with these general terms and conditions, must be accurate, complete and truthful.
• Your content must not be deceptive, fraudulent.

7. CHANGES AND UPDATES

Chotcut may make changes to these Terms from time to time. When it does so, Chotcut will post the most current version of the Terms and, if a revision to the Terms is material, Chotcut will notify you of the new Terms (for example, by email or a notification on the Store area of our website). Changes to these terms will not apply retroactively. If you do not agree to the modified terms, you should discontinue your use of the Chotcut.

You understand that, Chotcut may, at its sole discretion, provide updates and changes to the Chotcut Platform and that it is your responsibility to update the pilots App when updates are available. Chotcut is not liable for any loss that you may suffer as a result of your failure to update.
